Police Allowed to Search Citizens' Devices for Reasonable Reason



The police are allowed to search citizens' smart devices if they are suspected or have reason to believe that they have committed any criminal activity.


This was announced by the Inspector-General of Police, Tan Sri Razarudin Husain, who said that this matter is stipulated under Section 23 (1) of the Criminal Procedure Code if it is suspected that anyone has content or makes communications that are obscene, obscene, threatening and threatening.


These alleged offences are based on the provisions of Section 233 of the Communications and Multimedia Act (AKM) 1998.


However, he also said that these searches will only be carried out by police officers with the rank of at least Inspector and above. If any obscene materials are found on the phone, they can be arrested under Section 292 of the Penal Code without the need for any warrant.


If there is an online gambling application on someone's mobile phone, it is also a criminal offense that can be arrested without a warrant according to the Open Gambling Houses Act 1953.
